대 한민국의 주권자인 국민은 자유롭고 공정한 선거에 참여하고 그 제반 과정을 감시할 권리와 의무를 지닌다. 이번 18대 대선 개표 과정의 공정성에 대해 의혹을 제기하는 수많은 국민들의 제보와 관련 정황 증거들이 봇물처럼 터지고 있다. 그러나 국민의 권리와 의무를 가장 중립적이고도 공정하게 대변하고 앞장서 보호해야 할 기관인 중앙선거관리위원회(이하 중앙선관위)가 오히려 국민들을 호도하고 사실을 은폐 조작하려 하니 안타까움을 넘어 대한민국 국민의 일원으로서 개탄을 금할 수 없다. 어떤 선거이든지 선거 과정에 일점이라도 의혹이 제기되면, 중앙선관위는 충분한 근거를 제시하고, 모든 관련 자료와 관계자를 공개함으로써 개표의 공정성을 제고하고 국민을 납득 시켜야 할 의무가 있다.
그러나 중앙선관위는 2013년 1월 1일 자 공식발표문에서 다수의 국민을 “대선 결과에 불복”하는 일부 세력으로 폄하하였을 뿐만 아니라 “민주주의의 근간을 뒤흔드는 행위”를 멈추라며 국민을 계도하려 하였다. 이는 헌법상 독립기관으로서 선거의 중립성 및 공정성을 확보해야하는 선관위의 직분을 망각한 어리석고 오만한 태도이다. 더욱이 공식발표문의 "객관적 근거 없이 개표부정을 주장하며 재검표를 요구하고 있다"는 부분은 어불성설이다. 국민들은 산발적으로 불거진 의혹들과 정황 증거들을 토대로 합리적인 의혹을 제기했다. 모든 객관적 증거는 바로 선관위가 가지고 있으며, 객관적으로 이 모든 사태를 입증해야 하는 책임과 의무는 선관위에 있다. 이에 우리 해외 유권자 및 동포들은 선관위가 표명한 공식 입장에 대해 깊은 유감을 표시하며, 선관위가 다음 요구 사항들을 받아들여 선관위의 신뢰성을 회복하고 국민들의 의혹을 명확히 해소해 줄 것을 공개적으로 촉구하는 바이다.
1. 공정한 선거관리를 통해 국민의 주권행사를 돕고 주권의식을 높이는 것은 헌법에 명시된 선거관리위원회의 직무이다. 합리적 의심에 기초한 의혹을 제기하는 국민들의 구체적 요구를 무시하고 오만한 태도로 일관한 선관위는 즉각 사과하라. 국민들이 선거 과정에 의심을 품는다는 사실 자체가 이미 선관위가 그동안 국민들의 신뢰를 얻지 못했음을 의미하는 이상, 선관위는 오히려 이를 부끄럽게 여기고 이 기회에 본인들의 직무수행을 돌아보아야 할 것이다.
2.선관위가 1월 1일자 공식입장에서 밝혔듯 재검표를 피할 의사가 없다면, 훨씬 더 간단한 절차인 다음 자료 공개를 즉각 이행하기를 강력히 촉구한다: 총선거인 명부, 투표자 명부, 지역별 세대별 투표자 데이터, 시간별 각 개표소 개표 현황 및 개표 결과 전송 로그 기록, 중앙선관위 집계 결과 기록 및 언론사 전송 기록, 그리고 각 언론사 수신 및 방송 기록을 즉각 공개하라.
3. 개표기냐 투표지 분류기냐의 용어 구분은 중요하지 않다. 더이상 말 장난을 끝내고, 각 개표소에 배포된 전자개표기 소프트웨어, 중앙선관위 보고 시스템과 중앙선관위 최종 집계 시스템의 소스 코드를 공개하라. 또한 선관위 내부가 아닌 공정한 제 3자를 선정하여 이번 선거에 사용된 모든 기계와 프로그램의 타당성 및 공정성 여부를 조사하도록 의뢰하고 그 결과를 즉각 공개하라. 아울러, 전자개표기의 대통령 선거 적합성과 관련된 모든 내부 자료를 국민에게 공개하라.
4. 선관위는 투표지 분류기의 집계 결과는 최종 결과가 아니고 육안으로 재차 대조 확인을 했으므로 문제가 없다며 증거 자료 없이 주장만 하고 있다. 이 작업을 제대로 거쳤는지를 개표록 공개를 통해 증명하고, 이러한 수작업을 병행하였음에도 불구하고 개표시작 불과 3시간만 여 만에 당선이 확실하다는 발표가 나올 수 있는 지 객관적 자료를 근거로 해명하라.
5. 선거 전 투개표 참관인 교육이 이루어졌다면 자세한 교육 내용과 실제 교육이 이루어졌음을 확인할 수 있는 객관적인 기록을 공개하라. 더불어 정당별 참관인 수에 대한 각 개표소별 자료를 공개하라. 집계 심사부를 거친 최종 집계표에 각 정당 참관인 모두 표 집계 심사 결과에 이의 없이 확인 서명하였는지 공개하라.
모 든 객관적 증거는 바로 선관위가 가지고 있으며, 객관적으로 이 모든 사태를 입증해야 하는 책임과 의무는 선관위에 있다. 하여 우리는 중앙선거관리위원회가 오만한 태도의 주장을 벗어나 위에 제시된 모든 객관적 자료를 공개하여 국민의 신뢰를 회복하기를 강력히 촉구하며 성명서 발표에 동참한다.

Korea had the presidential election on December 19. The strong man's daughter, Geun-hye Park, was elected. But many Koreans affirm that the election was fraudulent and illegal. Many kinds of evidence for the affirmation were found. The important evidence is the electronic ballot counting. The electronic ballot counting is obviously illegal. Agora is driving a signature-collecting campaign for the manual ballot counting. The zeal of the campaign has been as hot as to get 250,000 Koreans to sign for the campaign in just 9 days after the election. The Korean government controls the press. So the Korean do not have the freedom of the press. And the major newspapers and broadcasting stations do not gather or report news about the fraudulent and illegal election. I would like to earnestly ask the foreign newspapers and broadcasting stations to gather and report news about the fraudulent and illegal election. These Questions Regarding the 18th Presidential Election
- A Second Statement by Fellow South Koreans and Voters Overseas
As sovereignty rests with the people in a democratic society, the Koreans have the right and the duty to participate in a free and fair election and monitor its process. Yet, we have an overwhelming number of questions about the fairness and accuracy of the vote counting in the 18th presidential election. Despite these accusations, the Republic of Korea National Election Commission (NEC), which is supposed to speak for and protect the rights of the people of Korea, has chosen instead to conceal and tarnish the intention of the people with healthy doubts. The Korean population is in a deep sorrow and despair about the situation, and it is the responsibility of NEC to address these concerns and disclose any information to the people of Korea to ensure that the election was conducted in all fairness.
In their official statement published on Jan 1st, 2013, the NEC depreciated many Koreans like us who want the electoral transparency and accountability, by calling them ‘a group of people who deny the result of the election,’ and further presented a condescending statement that those should stop ‘trying to shake the basis of democracy.’ We articulate that this is nothing but an inappropriate and arrogant response from NEC, of which impartiality and fairness are expected as an independent regulatory agency. It is absolutely illogical for NEC to allege that we are requesting a recount without any objective evidence. Koreans raised reasonable questions based upon testimonies and evidence collected. NEC has record of all raw data, and thus it is the duty of NEC to investigate and evaluate all information to prove the integrity of the election. Therefore, we fellow Koreans and voters abroad demand that NEC carry out the following actions to restore its credibility.
1. It is the NEC’s job to help people exercise their sovereignty, through fair and reliable management of an election. We insist that the NEC should apologize for their overbearing and condescending attitude toward Koreans who raised reasonable questions. The fact itself that many Koreans are raising questions about an election can only be considered as proof of NEC’s failure to earn public trust, and thus NEC should feel rather ashamed and look back on their job execution to see if anything could have been conducted differently in order not to raise so many concerns.
2. If the NEC is indeed willing to accept the request to recount as they publicized on Jan 1st, 2013, they must immediately make the following information available, which would be much simpler and easier than recounting: the register of all voters, the list of the actual voters, voter data per region and age group, the record of ballot counting at each office including the log data for data transmission, NEC's tabulating record and submission record to mass media, and the reporting data of each public broadcasting company.
3. The differentiation between the terminology of ballot counter or a ballot separator should not be of great significance. The NEC has to stop playing with words and face the problem by immediately providing the software of the ballot counters used and also the source code of NEC's central tabulating system and reporting system. A thorough investigation of the accuracy and reliability of those machines and systems ought to be carried out by an independent third party, and the results should be reported to the public. In addition, the NEC must release all documentation regarding the justifiability of the use of an electronic ballot counting system or voting equipment.
4. The NEC claimed without any supporting evidence that the data from the central tabulator is not the final result and the data was inspected manually. If that is the case, NEC must to release the record of manual ballot counting and explain how it was possible then to announce the winner only three hours after the ballot counting started.
5. In order to verify NEC's claim, we would also like to review the record on whether or not and also how the vote and vote-counting observers were educated and trained on the ballot-counting process. We desire for the NEC to publicize the number of observers from each party at each vote-counting facility.
Again, all of the raw data is being kept and managed by NEC, and therefore it is NEC's job to prove the electoral transparency and accountability. We hereby sign this statement with the hope that NEC will regain Koreans' trust by withdrawing their authoritative attitude and releasing all related information for it is the right of the Republic of Korea and its people to have access to this information.
